Welcome to ArtConsole! These Terms of Service ("Terms") govern your access to and use of the ArtConsole website, web application, and related services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Service.
Acceptance of Terms
By accessing or using ArtConsole, you confirm that you are at least 13 years of age (or the age of digital consent in your jurisdiction). If you are accessing the Service on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to these Terms.
User Accounts
To access and use ArtConsole—including managing inventory, tracking sales data, issuing invoices, and maintaining client records—you must create an account. The Service is entirely gated and cannot be accessed or utilized without registration.
- Account Security: You are responsible for safeguarding your password and for all activities that occur under your account.
- Accurate Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.
- Account Termination by User: You may delete your account at any time through your account settings.
User Content and Workspace Privacy
ArtConsole is designed exclusively as a private internal management platform for your gallery.
- Content Ownership: You retain complete ownership of all artwork inventory, client records, sales information, invoices, and any other data you upload or input into the Service ("User Content").
- Restricted Workspace Access: Your User Content is strictly confidential. It is accessible only to the primary account owner and authorized gallery members who have been explicitly invited to join your workspace.
- No Public Display: ArtConsole will never publicly display, share, or syndicate your uploaded artworks or gallery data. The platform's sole purpose is internal operational management, and your data remains securely contained within your team's designated environment.
- Team Management: The primary account owner is solely responsible for managing invitations, maintaining active team rosters, and overseeing the access permissions of invited gallery members.
Prohibited Conduct
To maintain a safe and inspiring community for all artists and art enthusiasts, you agree not to engage in any of the following activities:
- Illegal Activity: Violating any applicable local, national, or international law or regulation.
- Intellectual Property Infringement: Uploading content that infringes on the copyrights, trademarks, or intellectual property rights of others. Plagiarism and unauthorized use of third-party assets are strictly forbidden.
- Hate Speech and Harassment: Posting content or comments that are abusive, threatening, defamatory, or promote violence or discrimination against protected groups.
- Platform Abuse: Attempting to hack, destabilize, or scrape the ArtConsole platform, or distributing viruses and malware.
- Spam:Generating automated, repetitive, or unauthorized promotional messages or content.
Account Suspension and Termination
We reserve the right to suspend or terminate your account and your access to the Service at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease.
Disclaimer of Warranties and Limitation of Liability
Disclaimer: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ARTCONSOLE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
To the maximum extent permitted by applicable law, ArtConsole and its affiliates, directors, or employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Toronto, Ontario.
Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms.
